Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the website haulam.com (the “Website”) and any services, shipments, logistics, or other operations we perform (the “Services”) by Nocodek Technologies Ltd (“Haulam”, “we”, “us”, “our”). By using the Website or the Services, you (“you”, “Customer”, “User”) agree to these Terms.
1. Definitions

“Shipment” means any parcel, package, goods, or items you ask us to transport, handle, ship, deliver, or otherwise facilitate.

“Declared Value” means the value you assign to a Shipment for customs, insurance or liability purposes.

“Third-Party Carrier / Partner” means any external transporter, courier, customs agent, or service provider engaged by Haulam in connection with a Shipment.

“KYC Documents” means any identity documents, proof of address, or other documentation Haulam requires to verify your identity or address.

“Proof of Purchase Documents” means invoices, receipts, purchase orders, or other evidence of ownership or acquisition of the items in a Shipment.

“Shop & Ship Order” means an order where Haulam receives items on your behalf at a foreign/overseas address, then forwards them to your preferred location.
2. Use of Services & User Obligations

You must provide complete, accurate, current and truthful information when registering, shipping, or otherwise using our Services.

You are responsible for properly packaging your Shipment and complying with all applicable local, national, and international laws (including customs, import/export, safety, etc.).

KYC & Identity Verification: Haulam may request KYC Documents from registered Users at any time. You must supply such documents promptly upon request. Failure to do so may result in suspension, delay, or cancellation of your account or any pending Shipment(s).

Proof of Purchase Requirement: Before Haulam ships your items to your preferred location, Haulam may request Proof of Purchase Documents for the items in your Shipment. If you do not provide satisfactory proof, we may delay, refuse, or hold the Shipment.
3. Shipping, Delivery & Pickup

Haulam will use reasonable efforts to effect pickup, shipping, transit, and delivery/pickup in accordance with the option you select.

All delivery and pickup times are estimates only; Haulam is not liable for delays caused by customs, regulatory inspections, weather, force majeure, carrier delays, or other factors beyond Haulam’s control.
4. Shipping Rates, Duties & Fees

The applicable rates, fees, taxes, duties, surcharges, or other charges will be those in force when you request the Service or as communicated by Haulam.

You are responsible for any customs duties, taxes, import/export fees, or other governmental charges unless Haulam explicitly states otherwise.
5. Returns for Shop & Ship Orders

For Shop & Ship orders arriving at any of our foreign locations:

You may request a return only if the item has not yet been processed by Haulam (i.e., has not been packed for shipment onward).

You, the Customer, are responsible for all return shipping fees or associated costs for returning the item to the original store or seller.

Once the item has been processed (packed), we may not accept a return on your behalf.

6. Prohibited Items & Compliance

You agree not to ship any items that are illegal, prohibited, or restricted under local or international law, or items disallowed under Haulam’s policies (e.g. hazardous materials, perishable goods not permitted, etc.).

If prohibited or restricted items are included, Haulam may refuse to accept, hold, return, or dispose of them, at your risk and expense.
7. Fraud, Misrepresentation & Reporting

Suspected Fraudulent Purchases: If Haulam reasonably suspects that a purchase is fraudulent (including, but not limited to, misrepresentation of identity, stolen payment method, counterfeit or misrepresented items):

Haulam has the right to suspend, delay, or cancel the order or shipment.

Haulam may require additional verification (KYC documents, proof of purchase, etc.).

Haulam will report suspected fraudulent activity to relevant authorities in Nigeria (such as the Economic and Financial Crimes Commission (EFCC), Nigerian Police, or other regulatory bodies) and to the authorities in any foreign country involved in the transaction.

You agree that you will cooperate fully in any investigation of suspected fraud, including providing requested information or documents.
8. Liability & Claims

Limitation of Liability: Haulam’s liability in respect of any Shipment, whether for loss, damage, or delay, is limited to N10,000 (Ten thousand naira) only, except where law requires greater liability.

Claims for loss, damage, or delay must be made in writing within Haulam’s published time limit, and must include required documentation (which may include proof of purchase, photos, etc.).

Haulam is not liable for losses arising from incorrect information supplied, improper packaging, items prohibited or restricted by law, or delays outside Haulam’s control.
9. Intellectual Property

All contents of the Website (text, graphics, logos, software, etc.) are owned or licensed by Haulam. You may not use these except as expressly permitted.
10. Feedback, User Content & Hyperlinks

If you post reviews or feedback, you assign Haulam a royalty-free, perpetual, worldwide license to use, reproduce, distribute, display, modify, etc. such feedback.

You warrant that anything you submit (feedback or other user content) is lawful and does not infringe any third-party rights.

Rules for hyperlinks: permitted subject to Haulam’s guidelines; you may not imply endorsement without permission.
11. Privacy, Cookies & Data

We handle your personal data in accordance with our Privacy Policy. By using the Website/Services, you consent to our collection and use of your personal information and to cookies, as described in the Privacy Policy.

KYC Documents, Proof of Purchase Documents, and other user data will be handled in accordance with privacy, data protection, and retention policies.
12. Warranty, Disclaimers & “As Is”

The Services and Website are provided “as is” without warranties of any kind except as required by law.

Haulam does not warrant that the Website will always be available, error-free, or free of viruses or malicious code.

Other implied warranties (merchantability, fitness for a particular purpose, etc.) are excluded to the extent permitted by law.
13. Indemnification

You agree to indemnify, defend, and hold harmless Haulam, its affiliates, employees, agents, officers, etc., from and against any claims, losses, damages, liabilities, expenses (including legal costs) arising from your breach of these Terms, your Shipment(s), your user content, or misuse of Services.
14. Modifications & Termination

Haulam may change these Terms at any time. We will provide notice (e.g. via the Website or email) before changes take effect. Continued use after notice means your acceptance of the updated Terms.

Haulam may suspend or terminate your access to the Website or Services, or decline shipments, particularly if you fail to meet obligations (e.g. providing KYC Documents, Proof of Purchase, etc.) or where suspicion of fraud arises.
15. Governing Law, Jurisdiction & Dispute Resolution

These Terms are governed by the laws of The Federal Republic of Nigeria.

These Terms shall be governed by laws of The Federal Republic of Nigeria, without regard to its conflict of law provisions.
16. Severability

If any provision of these Terms is found invalid, illegal or unenforceable, that provision will be removed or limited to the extent necessary, and the remaining provisions will continue in full force.
17. Entire Agreement

These Terms, together with the Privacy Policy, any other policy or agreement expressly incorporated by reference, constitute the entire agreement between you and Haulam concerning the subject matter hereof, superseding prior or contemporaneous communications, proposals or agreements.
